The Federal Government will seek to have the Australian Capital Territory’s same-sex marriage laws passed this week overturned by the High Court, arguing they are inconsistent with the Commonwealth Marriage and Family Law Acts.

The dean of the University of Adelaide School of Law, Professor John Williams, said there is a possibility the laws could be overturned and, while a State would be in a stronger position than the ACT, it remains uncertain if even the Commonwealth has the power to legalise same-sex marriage.
